By the mere fact of continuing to browse and use this platform or website you accept compliance with and subjection to these Terms of Use (T&C) established by and its affiliated services; These T&Cs together with the privacy policy in accordance with the Spanish Data Protection Law (LOPD) and the European GDPR are the rules under which the use of this platform is governed. At any time TICKETERUM.COM may modify this T&C agreement if it deems it appropriate and in order to provide a better service for the user.

2.2 Each version of this T&C will be identified at the top of the page on its effective date. If you continue to use the service after the notification and effective date, you are constituting acceptance of the new T&C.

3.1 If there are events for minors, they must comply with all current legislation on the protection of data to minors as well as collect parental authorization from the Organizer of the event.

3.2 Each new Event Organiser will go through a verification process after completing their registration. The Organizer may continue to use the site during the approval process. But if not approved, your account will be deleted from the platform immediately. This verification process has the strict purpose of verifying whether it meets the integrity requirements outlined in this agreement. TICKETERUM.COM assumes no responsibility for the current or future intentions, past history or any legal history of any Organizer including representatives of companies.

3.3 If at any time during your registration it is detected that the information is doubtful, false or does not conform to the fundamental values, integrity and criteria of good use of this platform, your account will be suspended or deleted from the system. TICKETERUM.COM reserves the right to delete any account at any time, without notice.

3.4 Multi-level marketing (MLM) programs, home-based businesses, pornography/pornography-related businesses, or adult entertainment businesses are NOT allowed on this platform.

3.5 NO Spam- To maintain the integrity of this platform and to comply with the LOPD and the LSSICE, the account of any Organizer who is reported for spam will TICKETERUM.COM deleted. Spam is considered, for the purposes of these T&C, as the dissemination and sending of promotional material through text or documents without first having the consent of the recipient.

3.6 The content of the pages of this website platform is for informational purposes only and for general use, and is subject to change without prior notice.

3.7 Each Organiser acknowledges that all information it submits to TICKETERUM.COM is accurate, true, truthful and current.

3.8 TICKETERUM.COM nor any third party contributors make no warranties or warranties as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this website for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for such inaccuracies or errors to the fullest extent permitted by law.

3.9 The use of any information or material is used by each Event Organiser at its own risk and responsibility, for which TICKETERUM.COM will never be liable. It will be your own responsibility to ensure that any products, services or information available through this website meet your specific requirements.

3.10 All intellectual and industrial property rights that this platform incorporates or displays are the property of TICKETERUM.COM, its subsidiaries or work partners and is protected by the provisions of Royal Legislative Decree 1/1996, of April 12, which approves the revised text of the Intellectual Property Law, according to the wording given by Law 5/1998 of March 6, being subject to protection not only the data contained therein, but also as a collection / systematization of data, in the terms provided for in article 133 and following of the current Intellectual Property Law. Access to the Information authorized and regulated through these conditions, does not imply the transmission of any other of the rights derived from the Intellectual Property of this and other copyright laws, patents and trademark laws and other laws. 3.11 Unauthorised use of this website may give rise to a claim for damages and/or be a crime.

3.12 This website may also include links to other websites of third parties, whose privacy policies are alien to that of TICKETERUM.COM. These links are provided for your convenience and to provide more information. This does not mean that TICKETERUM.COM endorses the website(s). We are not responsible for the content of linked websites. By accessing such websites you can decide whether to accept their privacy and cookie policies. 5.1 Subject to the terms of this T&C, TICKETERUM.COM grants you a personal, non-exclusive, revocable and non-transferable license to use the Event Services, including the TICKETERUM.COM Platform. Some of the TICKETERUM.COM services are provided free of charge, while others are provided at a fee.

5.2 In accordance with this T&C, you will be able to access the entire platform and all the services you provide, depending on the subscription level and a short verification process. Any violation of these terms and conditions set forth in this agreement will result in the immediate suspension or termination of your account.

5.3 You may not use the system (by way of example only) to create chains, send spam, spam, unsolicited messages, use "pyramid schemes" or conduct surveys with information found or in circulation on the TICKETERUM.COM platform.

6.1 This website contains material owned or licensed by KEBLAR SOLUTIONS S.L., with all industrial and intellectual property rights in accordance with what is stated in section 3 of this T&C, in relation to industrial and intellectual property rights, namely but not limited to design, appearance, appearance and graphics. 6.3 The materials published by the Event Organizer such as photographs, videos, texts, logos and other graphic, audiovisual or text elements are the sole and exclusive responsibility of the person who publishes it. The Organizer undertakes to have the image and copyright rights necessary for the use and dissemination of such material.
The Organizer assigns the rights to such graphic material to TICKETERUM.COM at the time of creating the page for the event.

7.1 Cost of the service:
For free events the service is free. For the rest of the paid events , you can consult the cost of the service always updated on the following page: http://www.tickterum.com/pricing

7.2 Invoicing:
The Event Organizer will be responsible for billing the event attendees directly.
TICKETERUM.COM acts solely as a custodial intermediary in the event ticketing process, but does not provide the event organization service nor is it responsible for it.
The user who wishes to do so may expressly request the Organizer to receive an invoice for the payment of the purchase of the event ticket.

7.3 Payments:
TICKETERUM.COM paid by bank transfer to the Organizer of the event after 48h-72h of the end of the event, being able to advance a part of the amount to the Organizer for logistical needs or other reasons.
The Organizer must indicate your billing and bank account details in the Settings tab of your profile, so that you can receive payment.
The organizer will receive payment of the entire amount collected in the registrations to your event less the management fee, which can be consulted on the page of the price plans.
Along with the transfer, the organizer will also receive an invoice corresponding to the management fee charged and deducted from the amount transferred.

7.4 Refund Policy:
The Organizer of the event will be responsible for the refund or not to all participants of the event of the amount of the tickets, HAVING NO RESPONSIBILITY TICKETERUM.COM IN THE POSSIBLE CANCELLATION OF THE EVENT for any reason.
The decision to cancel the event voluntarily or involuntarily (for reasons beyond its control, such as the weather) is solely and exclusively of the Organizer, who is the one who has collected the tickets through the TICKETERUM.COM platform. It is the Organizer of the event that guarantees its Refund and by accepting these terms and conditions of use it affirms, accepts and acknowledges it.
The Refund cost is € 0.5 / refunded ticket.
In no case will there be a refund of the commissions accrued for the management of ticket sales. TICKETERUM.COM will not refund to the Organizer of the event the commission charged for the sale of tickets made from this platform.
TICKETERUM.COM will not refund the cost of developing and integrating the Organizer's own POS (Premium version) in case of cancellation of the event or non-use of said page by it.

8.1 Prior to the use of the platform and to have an Organizer account it is necessary to register in it. Accounts are only available to individuals over 18 years of age.

8.2 Event Organizers suspended, expired, cancelled or removed from the TICKETERUM.COM platform by TICKETERUM.COM staff may not create another account.

8.3 The above points also apply to accounts related to another type of use of the platform, such as nightclub managers or restaurant owners who also use TICKETERUM.COM to manage access and / or reservations to the services they provide.

9.1 In order to provide a safe and quality service to our users and in compliance with applicable legislation, TICKETERUM.COM establishes a series of guidelines that regulate good practices when interacting with the TICKETERUM.COM platform. Therefore, the USER acknowledges having reviewed the rules of good practices indicated below and accepts them.
Any violation of these rules or other terms described in this T&C may result in the termination of your access to TICKETERUM.COM or any services of its affiliates or partners.

9.2 To use the platform TICKETERUM.COM including any affiliate services, you agree to the following general terms, and agree to:

• DO NOT Commit Unlawful Acts.
• NO Spamming or sending any promotional material to other members without their consent.
• DO NOT Collect or resell personal information from other members or any information circulating on the TICKETERUM.COM platform. In addition, you agree not to obtain or attempt to obtain information or materials that are not intentionally or intentionally made available to you by TICKETERUM.COM.
• DO NOT harass other members through humiliating or slanderous comments.
• DO NOT register or present yourself or any third party in a fraudulent or misleading manner.

• DO NOT use any offensive or unprofessional profile picture in your virtual office. TICKETERUM.COM is a professional platform and encourages members to use "professional" portraits for their avatar. TICKETERUM.COM reserves the right, in its sole discretion, to delete any profile photos that do not conform to the values of the TICKETERUM.COM platform and to cancel, suspend or cancel the account of the infringers at any time.
• You may NOT use the TICKETERUM.COM platform for the transmission of any obscene, defamatory, harassing, abusive, threatening, invasive information of a user's privacy or in violation of the intellectual property rights of any other individual or entity.

9.3 When using this platform, you will be subject to all the terms and conditions described in these areas. Any violation of the terms set forth above, including but not limited to any other term set forth in this T&C, will result in the immediate removal, cancellation or suspension of your account.

10.1 By signing this agreement (or continuing to browse), you consent to TICKETERUM.COM reserving the right, in its sole discretion, to delete, cancel or suspend your account without notice at any time. TICKETERUM.COM has the right, but not the obligation, to terminate or suspend your user account and all access including, but not limited to, open offers, open project rooms, stored files, communications or files in transit and/or any general user account and communications by blocking you out of your account and ceasing all activity immediately without notice.

10.2 TICKETERUM.COM has no obligation to forward messages, files, text or store any communication or document in its virtual office or project room upon completion.

10.3 TICKETERUM.COM is not liable for any damages including subscription (charges made by you after termination or suspension by failing to provide reasonable time to act on its termination) or charges associated with suspension or cancellation of your account.

10.4 You may unsubscribe as an Event Organizer at any time, with or without cause, upon notice to TICKETERUM.COM as specified in the TICKETERUM.COM help link or simply by selecting the delete account link, provided that you are responsible for all charges, if applicable, that have been submitted prior to your termination notice, as set out below.

10.5 If you have posted a paid event you can cancel it before the ticket sales begin to avoid charging the commission for each sale of each ticket in TICKETERUM.COM, since once the sale is made, there would be no refund of the commission charged.

10.6 Termination, cancellation or suspension of your account, whether by you or TICKETERUM.COM, will not alter your obligation to pay all charges (if applicable) prior to such removal, cancellation or suspension. You will not be entitled to any refund following the removal, cancellation or suspension of your subscription.

11.1 By signing this agreement (or continuing to browse), you agree that TICKETERUM.COM reserves the right, in its sole discretion, to delete, cancel or suspend your FREE account without notice, at any time due to inactivity.

13.1 Through this website, no personal data is collected from users without their knowledge, nor is it transferred to third parties without their consent.
In order to offer you the best service and in order to facilitate use, the number of pages visited, the number of visits, as well as the activity of visitors and their frequency of use are analyzed. For these purposes, the AEPD uses the statistical information prepared by the Internet Service Provider.

13.2 An Organizer may choose to make specific personal or private information visible through the TICKETERUM.COM Platform. You may not disclose information obtained in this way to third parties without first obtaining permission from that user. You agree not to collect or aggregate user information accessible through the TICKETERUM.COM Web site for commercial use or redistribution, including targeted marketing of TICKETERUM.COM services to individual users.

13.3 TICKETERUM.COM/KEBLAR SOLUTIONS S.L. complies at all times with all its obligations in accordance with the provisions of the Spanish Organic Law on Data Protection, the Regulations of said Law and the Law on Services of the Information Society and Electronic Commerce.
In particular, and in compliance with the provisions of the LOPD, you are informed that the personal data provided or provided as a result of the acceptance of these T&C, will be incorporated into a file, owned by each File Manager , expressly consenting by acceptance of these T&C, the processing of the data provided, being the purpose of the treatment the adequate management of the contractual relationship and the contracting of the services. 13.4 Each user accepts and expresses his interest in being able to communicate the celebration of other events and information related to the same theme or areas of interest.

13.6 The data provided to the Event Organiser will be incorporated into a file of the Event Organiser. TICKETERUM.COM will only be responsible for processing ticket sales through this platform.

13.7 With the registration to the EVENT, users and participants also provide their data to a TICKETERUM.COM file for the correct provision of the service.

13.8 Users and participants accept and declare that they are interested in being informed of similar events and being able to provide them with information related to the same topic or areas of interest.

13.9 In compliance with the provisions of article 5 of the LOPD, it is reiterated and informed that the personal data that is collected directly from the user through the different resources available on the portal and on this platform, will be treated confidentially and will be incorporated into the respective files for which TICKETERUM.COM is responsible in those cases so specified, with the purposes detailed in the General Registry of Data Protection not being used for purposes incompatible with them. The data collected may be transferred in the cases provided, for each file, in said Registry.

13.10 TICKETERUM.COM is not responsible for the specific files of the Organizer or Organizers of the events, since it only provides the platform and technical tools for the registration to the events. In this case, the Organizer or Organizers of the events are responsible for the respective files and TICKETERUM.COM will be, in any case, in charge of the treatment.

13.11 The Event Organizers declare and acknowledge that they comply and will comply at all times with the privacy policy and the provisions of the current Spanish Data Protection Law.

13.12 By using this site you agree to the use of cookies for analysis, personalized content and, where appropriate, advertising.

13.13 The sale of data to third parties is prohibited.
TICKETERUM.COM will not transfer user data to third parties that are not directly responsible for organizing the event to which the user has registered.
We are committed to ethical and responsible privacy behavior, not being also our business, the resale of data.

13.14 We may share your Personal Data with our contractors and service providers who process Personal Data on our behalf to perform certain functions necessary for the operation of the service such as database recovery in case of problems on servers or email sending companies for sending notifications, payment confirmations, etc...
When we engage another company to perform such functions, we may provide them with information, including personal data, in connection with the performance of such functions.
We will never sell or transfer personal data for commercial or marketing purposes to third parties.

13.15 When you purchase tickets, register or make a donation to an event through the event page, we provide the Personal Data registered at the corresponding event to the organisers of that event. For donation collection pages, we may provide your Personal Data to both the Organising charity of the donation page and the Organiser of the event to which the fundraising page is linked. In some cases, an Organizer may designate a third party, who may or may not be affiliated with the Organizer, to create an event or fundraising page on its behalf (we call these third parties ("Third Party Organizers"). For example, and without limitation, a concert hall (the Organizer, in this case) may allow third party promoters or production companies (the Third Party Organizers) to create events that will be hosted at the Organizer's headquarters using your account. In that case, you can provide your personal data to third-party organizers on behalf of the organizers. We are not responsible for the actions of these organizers, or their third-party organizers, with respect to your personal data. It is important that you review the applicable policies of the organizers, and if applicable and available, also those designated third-party organizers before providing personal data or other information related to that event.
Similarly, if you are a member of an Organizer's organization on our platform, your Personal Data will be available to the Organizer and will be shared with third-party Organizers that the Organizer has granted permission to view to all members of the Organizer's organization.

However, if you registerfor an event as a ticket buyer, we will process your Personal Data to help manage that event on behalf of the Organiser (e.g. by sending confirmation or processing payment emails, etc.) and to assist the Organiser's purpose, and to understand the success of your event and event planning (e.g. provide event reports, etc.). In these circumstances, we simply provide the "tools" for the organizers; we do not decide which Personal Data to request in the registration forms, nor are we responsible for the continued accuracy of the personal data provided. Therefore, any questions you mayhave regarding your Personal Data and your rights under data protection law should bedirectedto the Organiser as the data controller.

As an Organizer, the use of our API and iframe implies acceptance of the Privacy Policy described above.
As a consumer, you should be aware that your Personal Data may be collected and processed through our API or iframe system on third party pages of the Organizer.

14.1 In no casoTICKETERUM.COM, nor its collaborators or its affiliates, employees, agents, suppliers or licensors acknowledge any warranty or representation on the "website" of the TICKETERUM.COM platform, including but not limited to its accuracy, completeness, reliability or validity. At no time shall TICKETERUM.COM be subject to liability for the truthfulness, completeness or accuracy of any information, documents, text or communications available through the platform TICKETERUM.COM for errors, omissions or errors in it or for any delay or interruption of data or flow of information for any reason.
TICKETERUM.COM is only an intermediation platform so by using our platform you accept and acknowledge that TICKETERUM.COM only provides a centralized linking system and cannot be held responsible for any damage you may suffer while using this platform. 14.2 In no event shall TICKETERUM.COM be liable for any damages, including but not limited to cancellation of events, incidental and consequential damages, deletion, corruption or failure to store any message, file or document or other content maintained or transmitted by any service; Loss of profits, loss of profits, damages resulting from loss of data or business interruption resulting from the use or inability to use of a person or entity, or from the submission of any material through our site, whether by warranty, contract or tort (including negligence), or any other legal theory, even if a TICKETERUM.COM has been informed of such damages.

14.6 YOU SPECIFICALLY AGREE THAT TICKETERUM.COM IS NOT LIABLE TO YOU FOR ANY LOSS OR DAMAGE, INCLUDING DIRECT AND INDIRECT LOSSES, OR FOR OFFENSE CAUSED, OR FOR ANY THREAT, DIMENSION, OBSCENCE, OFFENSIVE OR ILLEGAL CONTENT UPLOADED TO THE PLATFORM BY A PARTY LIVE EVENT, OR FOR ANY INFRINGEMENT OF THE RIGHTS OF ANOTHER, INCLUDING INTELLECTUAL PROPERTY RIGHTS ARISING FROM THE CONDUCT OF A PARTY OTHER THAN AN EVENT.

14.7 TICKETERUM.COM in no case will be responsible or may be asked for compensation or compensation in case there may be technical or technological problems that prevent the proper functioning of the registration process for the event. Nor is it responsible for the fact that access to the event registration system is not possible from certain devices, platforms, browsers or other web access or display systems.
